Will Healthcare Reform affect “first, do no harm”?

Is it possible that legislators in Washington, DC can actually change the ethical boundaries of healthcare providers?  The American Medical Association’s answer is a resounding YES.  This well-respected organization contends that the “Better Care Reconciliation Act” violates the “first, do no harm” standard of care on many levels!  The US Senate released the discussion draft of the legislation on June 22, 2017 and the American Medical Association responded in just four days with a scathing letter to Senate leaders.

Most commonly known as the Hippocratic Oath, primum non nocere has been an axiom central to the practice of medicine – Above All, Do No Harm!  The concept dates back to the Middle Ages but is more commonly attributed to English Physician Thomas Sydenham and is used as a guide to the ethical practice of medicine.  It is intended to be a vivid reminder that every medical decision has the potential to do harm.  Another way to think about it is: when there is an existing problem, it may be better to do nothing than risk causing additional harm.

In the June 26th letter addressed to Majority Leader McConnell and Leader Schumer, the AMA presents a laundry list of concerns.  Most important is access to healthcare for ALL individuals. Proposals in the discussion draft convert Medicaid to a system that limits the federal government’s obligation to care for patients in need with a predetermined formula based on per-capita-caps.  In addition, the proposal artificially limits increases in Medicaid expenditures below medical inflation which threatens the ability of states to care for the most vulnerable patients.  The letter goes on to cite the AMA’s opposition to mandates that restrict where low income patients can receive treatment – in particular a […]

Assistant Physicians in Missouri

In May, 2017, the 99th Missouri General Assembly passed a provision that will provide some much needed relief to the primary care provider shortage in the state of Missouri.  As soon as the provision is signed by the governor, there will be a new healthcare provider designation – Assistant Physician.  You read that right!  I’m not mistakenly talking about Physician Assistants, this is a brand new category of heath care providers.

Missouri currently has 225 primary care physician shortage areas, including more than 25% of Missourians.  This means more than 1.5 million people in Missouri do not have ready access to a primary care physician.  Enter Assistant Physicians!


In order to apply for licensure as an Assistant Physician, you must meet the following qualifications:

  • Graduate from an accredited medical school (MD or DO)
  • Be a resident of the United States or a legal resident alien
  • Successfully complete Step 1 and Step 2 of the USMLE within 2 years of application*
  • Have not completed residency within 2 years of application*
  • Have proficiency in the English language

*there is an inserted provision which says any medical school graduate who could have applied for a license and complied with the above qualifications between August 28, 2014 and August 28, 2017 can apply and be deemed in compliance

Practice as an Assistant Physician

  • Within six months of licensure, you must enter into an Assistant Physician – Physician Collaborating Practice Arrangement
  • You may ONLY provide primary care
  • You may ONLY practice in medically underserved rural or urban areas.
  • You must clearly identify yourself to patients as an Assistant Physician and may use the terms “doctor”, “Dr.” or “doc”.
  • You must renew your license every three years and
  • You must comply with CME requirements

Texas Nurse Practitioners Moving Closer to Full Practice Authority in 2017

Will 2017 be the year that Texas Nurse Practitioners gain full practice authority?  For the first time in Texas legislative history, a House Committee heard testimony regarding full practice authority of Nurse Practitioners (Advanced Practice Registered Nurses).  This is a critical step in getting the legislation to the House floor for a vote!

HB1415 was authored by Representative Stephanie Klick of North Richland Hills and had the support of 22 fellow Representatives. Prior to her election in 2012, Rep. Klick was a practicing Nurse, Nurse Supervisor and Nursing Consultant. This bill is a reflection of her belief that Nurse Practitioners in Texas should be free to practice to the full extent of their education and expertise. Full practice authority of Nurse Practitioners is already the law in 22 states and the District of Columbia.

The goal of the bill is to provide greater access to health care, particularly in rural and medically under-served parts of the state.  Nurse Practitioners are a high-quality, cost-effective way to solve the critical shortage of primary care providers in Texas.  Allowing Nurse Practitioners to provide primary care to patients without the requirement that they first enter into a contract with a physician will bring health care to those who need it most!
